Erika Kirk sat just metres from the man accused of murdering her husband, the conservative activist Charlie Kirk, as a preliminary hearing opened in a Utah court on Monday – the first time the family had come face-to-face with the alleged killer since his arrest.

Kirk, a key ally of Donald Trump and founder of the youth organisation Turning Point USA, was fatally shot on 10 September 2025 while speaking on the campus of Utah Valley University. The 31-year-old father of two was an infamous commentator who opposed trans rights, supported gun control and advocated for religion.

Tyler Robinson, 23, was charged with aggravated murder, felony discharge of a firearm, obstructing justice and witness tampering. He has not entered a plea. Prosecutors are seeking the death penalty, while Robinson’s lawyers have asked the judge to take it off the table.

The hearing, which is scheduled to last through Friday, will determine whether there is enough evidence for a trial. Prosecutors laid out their case, presenting surveillance footage that law enforcement said showed Robinson on the campus four times on the day of the shooting – including hours after Kirk’s death.

Former Utah Valley University officer Christopher Bagley testified that he heard a rifle shot but spotted a pistol holster on the ground. He ran to the roof, knowing it had a clear line of sight to Kirk’s position, and discovered a red-and-black screwdriver that “looked out of place”. Bagley said he believed he had seen evidence of a sniper pad, describing a “disturbance” at the scene. Surveillance footage allegedly showed a person running to the edge of the roof and dropping down; Bagley found a shoe print in the grass.

Robinson’s defence lawyers questioned the footage, how their client was identified as a suspect and security at the school. Previously, they claimed the Bureau of Alcohol, Tobacco, Firearms and Explosives “was unable to identify the bullet recovered at autopsy to the rifle allegedly tied to Mr Robinson”.

Erika Kirk arrived at court separately from Kirk’s parents, Robert and Kathryn, and his sister Mary. Donald Trump Jr. was also in attendance. The family released a statement saying: “Every court proceeding serves as a painful reminder of his death and the loss that has irrevocably impacted our lives and the lives of his children. We remain deeply grateful for the support, prayers, and kindness we have received. This outpouring has sustained us during the darkest days of our lives.”

The hearing ended 15 minutes early after a private meeting between Judge Tony Graf and lawyers over a video clip that was said to have been altered. The prosecution asked for the evening to prepare more evidence.

Robinson, wearing a light-coloured suit, sat between his lawyers at the defence table as the case that will determine whether he stands trial continued.
